We will now give you an explanation of what it means and what you can do to prevent any such cases being held against you as an company for being negligent. we can give you a deeper definition of what the serious term means when an negligence case is brought forward against your directors or company. Right the full term negligence is defined as a civil wrong (tort) that requires unreasonably careless conduct or a violate of the common law duty of care that would result in a loss, damage or an injury.These are the common defences disposable to an employer in a case of supposed negligent taken ahead by an employee. The employer can guard his case with the next parameters. In That Respect was no obligation of care owed to the employee since the case related to something that did not take place during the flow of employment. If the incident did not occur while under the time of employment then there was no duty of care owed. If the incident was unforeseeable and you had done everything else that was pretty possible even if duty was owed then you still have just reason.yet if you did breach your duty of care if nothing or no one was hurt damaged and no loss occurred then you should be Right.The claiment voluntarily accepted the hazard (volenti non fit injuria) or that the example was out of the three year time limit. If the person knew the risks or maybe the case is taken up out of time. If the claimant does not take up the case within 3 years or they acknowledged the risk when the incident happened.
